Terms of Service

These Terms of Service ("Terms") govern your use of the FireFunded website and application (the "Service"), operated by Arbor Portfolio Management, LLC ("FireFunded," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

FireFunded is a software service that helps fire and EMS departments identify grant opportunities they may qualify for, assess their competitiveness, prepare grant applications and supporting materials, and manage post-award obligations. Certain features, including AI-assisted drafting and expert review, are available on paid plans.

2. No Guarantee of Grant Awards

FireFunded does not guarantee that you will be awarded any grant. The Service provides tools, information, and assistance to help you prepare and submit applications, but grant awards are determined solely by the funding agencies, based on their own criteria and processes. Competitiveness scores, eligibility assessments, and similar features are estimates and informational only — they are not promises of any outcome. You are solely responsible for the accuracy, completeness, and timely submission of your applications.

3. Your Responsibilities

You agree that:

• the information you provide is accurate and that you are authorized to provide it on behalf of your department;
• you will review, verify, and confirm the accuracy of all application content — including any AI-generated draft content — before submitting it to any funding agency;
• you are responsible for actually submitting your applications and meeting all deadlines and requirements of the funding agencies; and
• you will use the Service in compliance with all applicable laws and grant program rules.

4. AI-Assisted Content

The Service uses third-party artificial-intelligence tools to generate draft application content based on information you provide. AI-generated content is a starting draft and may contain errors or omissions. It is your responsibility to review and verify all content before use or submission. FireFunded is not responsible for any inaccuracies in AI-generated drafts that you submit without verification.

5. Fees, Plans, and Payment

Paid plans are offered on a subscription basis at the prices stated on the Service. By purchasing a paid plan, you authorize us (through our payment processor) to charge the applicable fee.

Our fees are flat subscription fees. We do not charge contingency or success fees based on whether you are awarded a grant.

All fees are non-refundable, except where required by law. Subscriptions and their renewal terms are as described at the point of purchase.

6. Expert Review (Paid Feature)

Where included in your plan, "expert review" means we provide written feedback on an application you submit for review, subject to the limits stated in the Service (for example, one expert review per application). Expert review is feedback and guidance only; it is not a guarantee of any outcome, and final responsibility for the application remains with you.

7. Intellectual Property

The Service, including its software, content, and design, is owned by Arbor Portfolio Management, LLC and protected by law. You retain ownership of the department and application information you provide. You grant us a limited license to use that information to provide the Service to you.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, or that the Service will be error-free, uninterrupted, or that any information (including grant data, deadlines, or eligibility) is accurate or current. You are responsible for verifying all grant information with the official funding source.

9. Limitation of Liability

To the maximum extent permitted by law, Arbor Portfolio Management, LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost grants, lost funding, lost profits, or lost data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

10. Indemnification

You agree to indemnify and hold harmless Arbor Portfolio Management, LLC from claims arising out of your use of the Service, your application submissions, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date. Continued use of the Service after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles.
